The Supreme Court confirmed the judgment sentencing a couple to pay more than 463. 000 euros to the developer which bought two duplex penthouses Catarroja (Valencia) for speculative purposes, obviating the deed and expenditure until the economic situation worsened and were in need of subrogation in the mortgage loan, which was denied because of his age and lack of creditworthiness. The Civil Court has confirmed the decision of the Provincial Court of Valencia in November 2009 that convicted Michael D. and Maria Rosa A. to grant the deed of sale of the two properties and to pay, at 2006 prices, the payment of the purchase to the merchant, together with default interest and legal costs. The Supreme Court declared that the company tested the defendants sold two houses with their lumber they bought to resell. After the construction, the defendants were required notarized twice for the execution of the deed of sale but did not appear. The purchase was made with reservation of transfer to third parties, provided that, after the purchase is put up posters announcing the sale. The couple claimed they had no intention to breach the contract and that the denial of subrogation in the mortgage loan by the bank was "unpredictable". "The economic situation was unlikely to restrict credit for what lack of foresight is not fulfilled," claimed. However, the Supreme Court denies the existence of supervening impossibility this assumption and complains that the appellants pretendieran "accept the benefits of speculation but the saleswoman impacting losses that may arise, which is contrary to good faith."
